These Terms of Use ("Terms") are a legal agreement between you ("User") and Ermal Hamzaj, the individual developer of UCInsights ("Developer", "we", "us"), regarding your use of the UCInsights mobile application and website ("App", "Service").
By creating an account, downloading, installing, or using the App you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.
UCInsights is a personal health companion for individuals living with ulcerative colitis (UC). The App allows you to:
UCInsights requires an account to use the App. You may register with an email address and password, or via Google Sign-In or Sign in with Apple.
We reserve the right to suspend or terminate accounts that violate these Terms.

Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on your devices solely for your personal, non-commercial use.

By using the App you acknowledge that the Developer is not liable for any health outcome arising from information presented within the App.
All health logs, notes, and personal data you enter into the App ("Your Content") are stored on your device and, when you are signed in, synced to your secure cloud account on Supabase. You retain full ownership of Your Content at all times.
By using the cloud sync feature, you grant the Developer a limited, non-exclusive licence to store and transmit Your Content solely for the purpose of providing the sync service to you. We do not access, analyse, sell, or share Your Content for any other purpose.
You are solely responsible for the accuracy of the information you log. You agree not to enter information that belongs to or identifies another person without their consent.
You may request deletion of your account and all associated data at any time by emailing info@ucinsights.org with the subject "Delete My Account". We will process your request within 30 days.
The App uses an AI language model to generate summaries and chat responses. You acknowledge that:
You agree not to submit queries that are abusive, illegal, or that violate the AI provider's acceptable use policies.

The App integrates with the following services. Your use of these services is subject to their respective terms and privacy policies.
The licence in Section 5 is limited to use on Apple-branded devices you own or control, per Apple Media Services Terms and Conditions.
The Developer is solely responsible for maintenance and support. Apple has no obligation to provide any such services.
In the event of any App failure to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
The Developer, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, regulatory compliance claims, and consumer protection claims.
In the event a third party claims the App infringes its intellectual property rights, the Developer — not Apple — is solely responsible for the investigation, defence, settlement, and discharge of that claim.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon your acceptance.
The Developer, not Google LLC, is solely responsible for the App, its content, and any claims arising from its use. Google Play is merely the distribution channel. Your use of the App on Android is also governed by the Google Play Terms of Service.
The App, including its design, code, text, graphics, logos, and all original content, is the exclusive property of Ermal Hamzaj and is protected by copyright and trademark law. "UCInsights" and the UCInsights logo are trademarks of Ermal Hamzaj.
Research content from PubMed, community content from Reddit, and news content from Google News are subject to the copyright of their respective owners.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
The Developer does not warrant that the App will be uninterrupted, error-free, or secure, or that AI-generated content is medically accurate.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF HEALTH, PERSONAL INJURY, LOSS OF DATA, OR LOSS OF REVENUE.
THE DEVELOPER'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR €10, WHICHEVER IS GREATER.
Nothing herein limits liability for death or personal injury caused by the Developer's negligence, or any liability that cannot be excluded under applicable law.
Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.
The Developer may release updates that add, change, or remove features. The Developer is not obligated to provide updates and may discontinue the App at any time. Third-party API services may be unavailable at times outside our control.
Your rights under these Terms will terminate automatically if you fail to comply with any provision. The Developer may terminate or suspend your account at any time for violations of these Terms.
Sections 6 (Medical Disclaimer), 13 (Intellectual Property), 14 (Disclaimers), 15 (Limitation of Liability), 19 (Governing Law), and 20 (Dispute Resolution) survive any termination.
These Terms are governed by the laws of the Republic of Turkey and, where applicable, European Union law. EU / EEA residents also benefit from the mandatory protections of their country of residence.
For any dispute, please first contact us at info@ucinsights.org. We will try to resolve it informally within 30 days.
If unresolved, either party may pursue resolution through the competent courts of the Developer's jurisdiction, subject to mandatory consumer protection laws in your country. EU consumers may also use the European Commission's Online Dispute Resolution platform.
We may update these Terms from time to time. Material changes will be communicated via a notice within the App. Continued use after changes constitutes acceptance. The current version is always at ucinsights.org/TermsOfUse.html.
